IF YOU WISH TO USE ALLEGHENY HEALTH NETWORK’S ("AHN") PATIENT PORTAL ("MYCHART"), YOU MUST READ AND AGREE TO THE FOLLOWING PATIENT PORTAL GENERAL TERMS AND CONDITIONS OF USE:


Welcome to Allegheny Health Network’s patient portal ("MyChart"). MyChart is an Internet application that allows for review of concise electronic health information and secure communication between patients or other health care providers utilizing AHN’s electronic medical record platform. MyChart allows patients to see details about their medical history and current health status, communicate with their health care providers regarding non-urgent issues and to perform other health-related tasks, such as scheduling appointments, paying bills, and viewing select portions of their AHN medical record. Enrolling in MyChart is optional and is not required in order to receive treatment; however, certain care-related services/programs may be exclusively offered through MyChart like Virtual Care (described more fully below).

By enrolling in MyChart, you are confirming the accuracy of all the personal information you have provided during the enrollment process. You are also confirming your ongoing request for, and authorization of, the release of those portions of your medical record made available in MyChart for review by you and others you have granted MyChart access permissions to, such as a proxy. If you wish to cease using MyChart, you must cancel your enrollment using the method described below. AHN provides timely release of your health information through MyChart as a matter of convenience and patient engagement. You are advised that MyChart represents a summary of your health history and clinical care; it does not represent your entire medical record maintained by AHN. For example, only certain pieces of information from your medical record, such as appointments, clinical notes, test results, medications, health issues, and immunizations are generally populated in MyChart (described more fully in the MyChart FAQs). MyChart may also not contain information from other legacy clinical systems or paper records. It is important to note that some items from your medical record might be delayed or withheld from release to MyChart, as permitted or required by applicable law, and/or in the professional discretion of a licensed clinician. Additionally, certain details related to your treatment records with AHN, such as names of caregivers, may be abbreviated when released through MyChart. If you would like to make a formal request for a full copy of your medical record maintained by AHN, you may elect to download a PDF through MyChart or you can submit a request through AHN’s Health Information Management (HIM) department by visiting the following website and then calling the applicable phone number: https://www.ahn.org/patients-visitors/patients/medical-records.html. AHN will timely fulfill your medical record request. AHN's provisioning of your medical records, including applying any related charges in connection to the request, is subject to AHN’s policies and procedures and applicable law.

You are advised of the following:

  • AHN is an integrated healthcare system consisting of primary and specialty care practices, hospitals, urgent care centers, outpatient surgery sites, diagnostic testing centers, and home health and medical equipment providers. As participants in an Organized Health Care Arrangement (OHCA), our constituent entities may access and share your information for healthcare operations of joint activities. This includes clinicians, clinical support staff, and other administrative personnel reviewing your record, including messages sent through MyChart, as necessary to conduct business matters.
  • MyChart is licensed and maintained by AHN.
  • AHN may be referred to as "we", "us", or "our" throughout this document.
  • The term "you" or "your" refers to authorized users of MyChart.

You should review this document in its entirety. By clicking "ACCEPT" below, you are creating a binding AGREEMENT between yourself and AHN.

PART I: DESCRIPTION OF SERVICES

A. Accessing your summary health information. MyChart provides you with secure access to portions of your medical record maintained by AHN. Not all of your health information is available through MyChart, as described above, including records maintained by non-AHN providers/external entities. Visit the MyChart FAQs for a more-detailed description of the portions of your medical record which are available through MyChart. Because the information available through MyChart does not represent the totality of your medical record, MyChart should not be solely relied upon as a singular representation of your complete health status.

Some of your healthcare providers may not use MyChart, and thus they may not be aware of some or all of the health information that is in your medical record. It is your responsibility to inform ALL of your healthcare providers about consults with, testing ordered by, and courses of treatment recommended by, other providers, as well as any other matters related to your overall health status.

B. Health-related links. In order to provide you with additional health-related resources, MyChart may contain links to external websites or services. By providing links to an external site or service, AHN makes no endorsements, representations, or warranties regarding such site or service. While we do select the provided links with care, we cannot guarantee the accuracy, security, or usefulness of the information within those sites. We do not accept any responsibility for external site and services, and you should not rely on the information found on external sites and services in lieu of seeking treatment or diagnosis of a medical condition. If you do choose to link to an external site, you will be advised that you are exiting MyChart.

C. Virtual Care. MyChart allows you to participate in eVisits, video visits, and other telehealth services (collectively "Virtual Care") from your home or other setting. By initiating a Virtual Care encounter, you will interact with an AHN provider through MyChart to assess certain non-emergent conditions. You will communicate by secure questionnaire, messaging, real-time video chat, or other electronic mechanism. For more details regarding Virtual Care with AHN, including available programs, associated costs, treatable symptoms, hours of service, etc., navigate to the Virtual Care link/page after logging into MyChart. You should be aware that you must be physically located within the Commonwealth of Pennsylvania to participate in a Virtual Care session

Virtual Care is not suitable for treating serious conditions or medical emergencies. IF YOU ARE EXPERIENCING A MEDICAL EMERGENCY OR SERIOUS CONDITION, CALL YOUR DOCTOR'S OFFICE, VISIT THE NEAREST EMERGENCY DEPARTMENT OR URGENT CARE CENTER, OR DIAL 911 IMMEDIATELY.

D. Online bill payment. MyChart allows you to pay your healthcare-related expenses online. AHN adheres to Payment Card Industry (PCI) information-processing and security standards, and securely maintains your financial information within MyChart.

E. Proxy/Family Access MyChart offers the option of designating a proxy to be granted access to your MyChart account ("Family Access"). Family Access and the ability to view information generally varies based upon the age of the patient, and has certain operating rules conditioned upon whether the patient is ages 0-12, ages 13-17, or age 18 and over. Individuals who have been designated as a proxy/Family Access user must use their own unique credentials to access MyChart; proxies are prohibited from using the patient’s MyChart credentials or otherwise impersonating the patient. F. Sharing your health record Through MyChart, you have the opportunity to share your health record with any provider, anywhere, on a temporary basis. You may request a one-time passcode through MyChart. Once the provider with whom you wish to share your health record uses that passcode to log in to a secure website to review your record, he/she will see the same information that you see when you log in to your MyChart account. PART II: UNINTENDED USE

A. Should not replace regular visits with your provider. MyChart provides convenient access to your health information and health maintenance resources, but it is not designed to replace regular visits with your health care provider. It is intended to enhance and supplement your patient experience and your role in managing your own health, but it should not eliminate ongoing healthcare or wellness activities, such as regular office visits/check-ups with your provider(s). You should not stop or change any course of treatment recommended by your provider without first consulting him/her.

B. Should not be used for seeking emergency care. EMERGENCY CARE IS NOT AVAILABLE THROUGH MYCHART. IF YOU ARE EXPERIENCING A MEDICAL EMERGENCY OR SERIOUS CONDITION, CALL YOUR DOCTOR'S OFFICE, VISIT THE NEAREST EMERGENCY DEPARTMENT OR URGENT CARE CENTER, OR DIAL 911 IMMEDIATELY.

C. Generally should not be accessed by minors. MyChart is generally not intended for use by minors under the age of 13. In accordance with Pennsylvania law, minors between the ages of 13 and 17 can sometimes consent to certain healthcare services independently, and also control access to information related to those services. In legally-prescribed situations, minors who are at least 13 years of age may request a MyChart account, and also revoke prior Family Access rights of a parent or legal guardian. Unless otherwise permitted, AHN does not knowingly collect personal information from a minor under the age of 13. If AHN determines that someone under the age of 13 has impermissibly created or otherwise misused a MyChart account, it may be disabled in AHN's sole discretion.



PART III: YOUR RESPONSIBILITIES

A. Monitoring account for messages and notifications. AHN may send you secure messages or notifications that contain important healthcare-related information via MyChart. For example, your provider may send you a message regarding recent test results, or you may receive a notification that you are due for a flu shot or have a billing statement due for payment. If you have a secure message or notification waiting to be viewed, you will be alerted at the primary email address you provided during MyChart account registration (example: JohnSmith@anymail.com), and upon logging into MyChart you can retrieve the message or notification. It is your responsibility to monitor your email address and your MyChart account to review these secure messages and notifications.

B. Safeguarding your email account. Because you will be notified via email when a secure message or notification is available in MyChart, any person with access to your email account would also be able to see these alerts. This could include your spouse, employer, or anyone else with access to or oversight of the primary email address you provided during MyChart account registration. Although no specific health information will be included in the email alert, the context of the alert may be information that you prefer to be kept confidential. You should consider this when providing an email account during enrollment in MyChart.

C. Understanding health-related communications. By using MyChart, you represent to AHN that all communications sent to your providers through your MyChart account will be about you and your own health, and not about someone else whose care you may be involved in. If you have been designated as a proxy with Family Access on someone else’s MyChart account, you are permitted to communicate about that individual and his/her health, but their information should not be commingled with your own health information. You acknowledge that the content of any communications sent through MyChart may be stored in your medical record, or in the medical record of the individual on whose behalf you are communicating if you are a proxy. AHN does not assume responsibility for use of health-related information by persons other than the MyChart enrollee.

D. Cancelling Enrollment. If you decide to discontinue your use of MyChart, you must call any of your AHN provider offices to cancel your enrollment. Should you cancel your enrollment, you will no longer be able to use or access MyChart or any of its programs, such as Virtual Care, prescription refill, or online bill pay, and your account will be deactivated. Any information stored in MyChart at the time your account is deactivated will be archived in our database per applicable recordkeeping requirements.

E. Requesting minor updates to health information. You have the opportunity to request minor updates to your health information via MyChart, and you should do so to ensure AHN has accurate and complete information on an ongoing basis. For example, if your account is displaying a medication that you are no longer taking, you can securely message your provider to ask that your record be updated accordingly.

F. Acceptable use. Upon creating a unique username and password and enrolling your account, you will be granted access to MyChart. Your use of MyChart must be in accordance with these General Terms and Conditions of Use, and your ongoing use of MyChart constitutes your continued acceptance of and agreement to comply with this document. Your use of MyChart must also be in compliance with all applicable laws, rules, and regulations. Failure to abide by any requirements or standards of acceptable use may result in AHN, in its sole discretion, suspending or terminating your MyChart access privileges.

G. Responsibility for activities related to account credentials. You are solely responsible for any activities related to/occurring under your MyChart username and password. You must immediately report to AHN:

  • Any suspected or actual unauthorized access to your account;
  • Any loss or misuse of your username or password; or
  • Any suspected or actual unauthorized disclosure of your health information.



PART IV: PRIVACY AND SECURITY; BEST PRACTICES

This section describes the privacy and security controls in place to safeguard your information in MyChart, and the steps you should follow to ensure that your information remains confidential and secure. MyChart employs reasonable security measures to help protect against the unauthorized access, loss, misuse, or alteration of information under AHN’s control. Despite these measures, the confidentiality of communications transmitted via the Internet or email cannot be guaranteed. There is always the possibility that an unauthorized person could intercept, read, and/or modify a communication sent to or received by AHN over the Internet or email.

As a patient of AHN, you have certain rights associated with your health information. These rights are established under state and federal law, and apply to the information in your medical record, including MyChart. For more information regarding patient rights and details about how we may use and disclose your health information in accordance with applicable law, refer to AHN’s Notice of Privacy Practices (NPP), which can be found on AHN.org (click here).

AHN collects personal information about you, such as name, email address, phone number, and other demographics, for MyChart account administration purposes. We also collect other information, such as geolocation (if enabled on your personal device), in order to deliver certain MyChart programs which are driven by your proximity to an AHN facility. For more information regarding what types of information we collect through your use of MyChart and other AHN platforms, and how such information is used, refer to AHN’s Online Privacy Policy (OPP), which can be found on AHN.org ( click here).

A. Unique username and password. Your username and password control access to your MyChart account and your health information within the account. DO NOT share your username or password with anyone. Sharing your username or password could compromise the confidentiality and security of your information in MyChart, and may result in AHN suspending or terminating your access privileges.

B. Location and connection awareness; logging out. You should be aware of choosing an appropriate location and connection method from which to access MyChart. You are advised that you could expose your information to compromise by accessing MyChart in a public space (e.g., a library or coffee shop) or over an unsecure network (e.g., open/guest wifi). You are solely responsible for any unauthorized access to or disclosure of your health information which may result from accessing MyChart in a public space or over an unsecure network. You can determine if your access method is secure by looking at your web browser’s location bar (URL). If the URL begins with "https" (rather than "http"), the session originates from a secure server. This means data is encrypted and cannot be read or deciphered by unauthorized individuals. Whenever you conclude a session in MyChart, be sure to properly log-out of the system/application to ensure that your information remains confidential and secure.

C. Information management We do not sell or rent any personal information we collect or receive through your use of MyChart. In accordance with our NPP and applicable law, AHN may exchange your health-related information with other parties for permissible purposes (such as treatment, payment, or healthcare operations).



PART V: MISCELLANEOUS

A. Right to suspend or terminate access privileges. AHN reserves the right to suspend or terminate your access to MyChart at any time, for any reason, and at its sole discretion. For example, your access privileges may be suspended or terminated if you violate these General Terms and Conditions of Use, or if AHN deems it necessary to prevent or mitigate risk to information. You will be notified if we suspend or terminate your access privileges.

B. MyChart is a private network. MyChart is a private Internet application provided and maintained by AHN on behalf of itself and its subsidiaries and affiliates. Unless we have specifically authorized you to access MyChart, it is a violation of state and federal law to attempt to access the private computer network of another individual or entity. Use of another individual’s username and password to access MyChart is not permitted and does not amount to authorization to use MyChart.

C. Updating the General Terms and Conditions of Use. AHN reserves the right to amend, modify, or otherwise revise these General Terms and Conditions of Use at any time, for any reason, and without notice. Revisions will be effective immediately upon publication and will apply to your information which we have already collected or received, as well as to any information collected or received moving forward. We encourage you to periodically review the General Terms and Conditions of Use to remain familiar with standards and expectations of use. As a reminder, your ongoing use of MyChart constitutes your continued acceptance of these General Terms and Conditions of Use. The date of the most recent revision will be clearly posted at the end of this document.

D. MyChart updates and improvements. AHN reserves the right to make changes, updates, and/or improvements to MyChart, as well as to any programs, products, and/or services provided through MyChart, at any time, for any reason, and without notice. Users may periodically be asked to complete voluntary surveys regarding their experience with MyChart as a way to help AHN gather feedback for making updates and improvements. Our surveys may ask participants for limited demographic information, such as name, age, gender, and education, to help categorize survey responses, but will not request specific medical information. In addition, users may be individually contacted for follow-up to address particular concerns or inquiries raised during their survey participation.

E. Monitoring, investigations, and audit. AHN reserves the right to monitor, investigate, and audit all activity occurring on MyChart, as well as any information stored in or transmitted through MyChart, at any time, for any reason, and without notice. By clicking "ACCEPT" below, you agree to cooperate fully with any investigations, inquiries, or audits conducted by AHN related to your MyChart account or any activity occuring thereunder.

F. Minimum system requirements and security. You can access MyChart via a desktop computer or laptop, provided the device is running Windows 2000 or later, Internet Explorer 10.0 or higher (other browsers are not supported at this time), and Adobe Reader/Professional 8.0 or higher. At least 512MB of RAM is recommended to support full functionality. You can also access MyChart via a mobile application on your smart phone. You are solely responsible for keeping your devices secure and in good working order, including updating your operating systems and applications, and applying product upgrades and security patches, as available.

G. MyChart unavailability. There may be times when MyChart is temporarily unavailable due to technical complications or during routine maintenance activities. AHN will make reasonable efforts to limit system maintenance to off-peak hours and resolve any technical issues as quickly as possible to minimize service interruptions.

H. WARRANTY DISCLAIMER. MYCHART AND ITS CONTENT AND PLATFORM-RELATED SERVICES/PROGRAMS ARE PROVIDED "AS IS," WITH ANY FAULTS AND WITH NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. YOU ASSUME TOTAL RESPONSIBILITY AND RISK FOR YOUR USE OF AND RELIANCE UPON THE INFORMATION CONTAINED WITHIN MYCHART, PLATFORM-RELATED SERVICES/PROGRAMS, AND HYPERLINKED ITEMS/MATERIALS. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY AHN OR ITS AUTHORIZED REPRESENTATIVES SHALL CREATE ANY REPRESENTATION OR WARRANTY OF ANY KIND.

I. LIMITATION OF LIABILITY. AHN, ITS PARENT, SUBSIDIARIES, AFFILIATES, AND THEIR RESPECTIVE OFFICERS, TRUSTEES, DIRECTORS, EMPLOYEES, AGENTS AND CONTRACTORS, AND ANY OTHER THIRD PARTIES MENTIONED ON MYCHART ARE NEITHER RESPONSIBLE NOR LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, PUNITIVE, OR OTHER DAMAGES (INCLUDING, WITHOUT LIMITATION, THOSE RESULTING FROM PERSONAL INJURY, LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION) ARISING OUT OF OR RELATING IN ANY WAY TO MYCHART, PLATFORM-RELATED SERVICES/PROGRAMS AND PRODUCTS, CONTENT OR INFORMATION CONTAINED WITHIN MYCHART, AND/OR ANY HYPERLINKED ITEMS/MATERIALS, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY AND WHETHER OR NOT ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOUR SOLE REMEDY FOR DISSATISFACTION WITH MYCHART, PLATFORM-RELATED SERVICES/PROGRAMS, AND/OR HYPERLINKED ITEMS/MATERIALS IS TO STOP USING MYCHART AND/OR THOSE SERVICES/PROGRAMS. IF APPLICABLE, LAW DOES NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, THEN THE ABOVE LIMITATION OR EXCLUSION WILL BE LIMITED AS REQUIRED BY APPLICABLE LAW.

J. Copyrights. Except as otherwise indicated, all content on MyChart is the property of AHN and/or its licensors and is protected by law, and may not be used by you except in connection with your usage of MyChart in accordance with these General Terms and Conditions of Use.

K. Trademarks and service marks. The names, words, symbols, and graphics representing AHN and MyChart are the trademarks or registered service marks of AHN and/or its licensors and are protected by federal law. Other proprietary names, words, symbols and graphics may be designated as such from time to time on MyChart through use of the TM, SM, or ® symbols. Users of MyChart are not authorized to make any use of the AHN marks, including, but not limited to, as meta-tags or in any other fashion which may create a false or misleading impression of affiliation or sponsorship with or by AHN.

L. Accuracy and integrity of information. Although we will make reasonable efforts to maintain the accuracy and integrity of your information within MyChart, we cannot guarantee that information will always be correct and complete since MyChart represents only a summary of your health information. It is possible that MyChart may include typographical errors or other inaccuracies. In the event that you do notice an error or inaccuracy, inform us promptly so that we can make the proper correction(s).

M. Infected or corrupted materials. To the extent files are available for download through MyChart, AHN makes reasonable efforts to maintain the integrity and security of such files, but it cannot and does not guarantee or warrant that such files will be free of infection such as viruses, worms, Trojan horses, or other code having contaminating or destructive properties, which could be introduced during a download process. AHN shall have no responsibility for any type of infection which results in the compromise of personal information and/or causes the user's device to malfunction.

N. No waiver. No delay or failure by AHN to enforce any provision of these General Terms and Conditions of Use shall constitute a waiver of the requirements of such provision. Any waiver granted by AHN must be in writing and issued by an authorized official, and shall apply solely to the specific instance expressly stated. A waiver of any specific term or condition shall not be construed as a waiver of any other provision of these General Terms and Conditions of Use, nor shall any waiver constitute a continuing waiver.

O. Choice of law. By using MyChart, you agree that the laws of the Commonwealth of Pennsylvania, without regard to principles of conflict of laws, will govern these General Terms and Conditions of Use and any dispute of any sort that might arise hereunder between you and AHN or any of its subsidiaries or affiliates. You agree not to commence or prosecute any action in connection therewith other than in the state and/or federal courts of Pennsylvania, and you hereby consent to, and waive all defenses of lack of, personal jurisdiction and forum non conveniens with respect to venue and jurisdiction in the state and/or federal courts of Pennsylvania.
